These Terms of Use and Online Sales Terms (the “Terms”) govern your access to and use of the Whitelip website located at whitelip.us, including any related pages, online store, content, tools, checkout flows, customer-service functions, and any products or services made available through the website (collectively, the “Site”).
The Site is operated by Whitelip Inc., an Illinois-based company (“Whitelip,” “we,” “us,” or “our”). By accessing the Site, creating an account, placing an order, or otherwise using the Site, you agree to be bound by these Terms and by any policies referenced in them, including our Privacy Policy and any shipping, return, age-verification, or product-specific policies posted on the Site. If you do not agree to these Terms, do not access the Site, create an account, or place an order.
1. Acceptance of These Terms
You represent that you have read, understood, and agree to these Terms. If you use the Site on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.
These Terms apply to all Site users, including visitors, customers, account holders, vendors, reviewers, and anyone who submits content or information through the Site.
Additional terms may apply to particular products, promotions, payment methods, subscription programs, or services. If additional terms conflict with these Terms, the additional terms control only for the relevant product, promotion, payment method, subscription, or service.
2. Adult-Only Eligibility and 21+ Requirement
The Site and all products containing nicotine are intended only for adults who are at least 21 years old. You may not access the Site, create an account, place an order, receive a delivery, or use our products if you are under 21 years old.

3. Age Verification and Identity Verification
We may use third-party age-verification, identity-verification, fraud-prevention, and compliance providers to confirm your age, identity, billing information, shipping eligibility, and order legitimacy. You authorize us and our service providers to collect, use, disclose, and verify information reasonably necessary for these purposes, including your name, date of birth, address, phone number, email address, government-issued identification details where required or appropriate, and transaction information.
You agree to provide accurate, current, and complete information. If we or our providers cannot verify that you are at least 21 years old or that an order may be lawfully fulfilled, we may refuse, cancel, delay, or hold the order.
A successful age-verification result does not guarantee that an order will be accepted or shipped. Orders remain subject to product availability, payment approval, fraud screening, shipping restrictions, state and local laws, and our internal compliance controls.
4. Nicotine Product Warning and Responsible Use
WARNING: Products sold on the Site may contain nicotine. Nicotine is an addictive chemical. No tobacco or nicotine product is safe or risk-free.
Products sold on the Site are not intended for anyone under 21, anyone who is pregnant or breastfeeding, anyone with a medical condition that may be affected by nicotine, anyone who has been advised by a healthcare professional to avoid nicotine, or anyone who does not already use nicotine products.
Use products only as directed on the product label and packaging. Keep all products away from children and pets. Do not use damaged, tampered, expired, leaking, or otherwise unsafe products. If accidental exposure, ingestion by a child or pet, allergic reaction, or other medical emergency occurs, seek immediate medical attention or contact poison control or emergency services. You assume responsibility for reading all labels, warnings, instructions, ingredients, and product information before use and for using products in a lawful and responsible manner.
5. No Medical Advice or Smoking-Cessation Claims
The Site, product descriptions, customer-service communications, marketing materials, reviews, and other content are provided for general informational and commercial purposes only. They are not medical advice and are not a substitute for consultation with a licensed healthcare professional.
Unless expressly stated in a product-specific authorization and permitted by law, products sold on the Site are not intended to diagnose, treat, cure, mitigate, or prevent any disease, and are not marketed as smoking-cessation, nicotine-replacement-therapy, or therapeutic products.
You should consult a healthcare professional before using nicotine products if you have questions about nicotine use, addiction, medication interactions, health conditions, pregnancy, breastfeeding, or cessation.
6. Product Authorization, Legal Availability, and State Restrictions
Products containing tobacco-derived nicotine or non-tobacco nicotine may be subject to federal, state, local, tribal, and territorial laws, including marketing-authorization, labeling, tax, shipping, flavor, registration, licensing, advertising, and age-verification requirements.
We offer products only where we determine, in our discretion, that they may be lawfully offered, sold, shipped, and delivered. Any offer of a product is void where prohibited. We may restrict sales by state, locality, ZIP code, product type, flavor, nicotine strength, customer status, carrier availability, or other compliance criteria.
If a product is subject to U.S. Food and Drug Administration marketing authorization or enforcement requirements, we may require confirmation that the product can be lawfully marketed before offering it for sale. If any product has received FDA marketing authorization, that authorization does not mean that the product is safe, risk-free, or “FDA approved.” We may cancel or refuse any order if we believe the product cannot lawfully be sold, shipped, delivered, received, possessed, or used at the destination address or by the recipient.
7. Accounts and Account Security
You may be required to create an account to access certain Site features or place an order. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You agree to provide accurate and current account, billing, shipping, contact, date-of-birth, and verification information and to update that information promptly if it changes. You must notify us immediately at support@whitelip.com if you believe your account has been compromised or used without authorization.
8. Orders, Acceptance, and Cancellation
Placing an order is an offer to purchase products subject to these Terms. An order confirmation, receipt, or payment authorization means that we received your order; it does not mean that we accepted the order or agreed to fulfill it.
We accept an order only when we ship the product or otherwise expressly confirm acceptance. We may refuse, cancel, limit, or hold any order at any time, including after payment authorization, if we suspect age-verification failure, fraud, resale, diversion, pricing error, product unavailability, regulatory restriction, shipping limitation, tax or payment issue, or violation of these Terms.
If we cancel an order after payment has been captured, we will refund the captured amount to the original payment method, except for non-refundable fees or costs to the extent permitted by law and disclosed at checkout or in these Terms.
We reserve the right to limit quantities, refuse orders that appear to be placed by resellers or distributors, and require additional documentation before accepting or fulfilling any order.
9. Prices, Taxes, and Payment
Prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, availability, shipping charges, adult-signature fees, taxes, excise taxes, regulatory fees, and other charges are subject to change without notice before order acceptance.
You are responsible for all applicable sales, use, excise, tobacco, nicotine, regulatory, import, shipping, handling, adult-signature, and other taxes and fees associated with your order. We may collect estimated taxes and fees at checkout, but you remain responsible for any additional amounts required by law.
We may use third-party payment processors, including card processors, digital wallets, fraud-prevention services, and payment-method providers such as Kustom or other invoice/pay-over-time providers. Your use of a third-party payment method may be subject to that provider’s terms and privacy notice.
You represent that you are authorized to use the payment method submitted and authorize us and our payment providers to charge all amounts due for your order, including taxes, shipping, adult-signature fees, and other disclosed charges.
10. Shipping, Delivery, and Adult Signature
We ship only to addresses where we determine shipping is available and lawful. We do not guarantee that shipping is available to every U.S. state, territory, locality, military address, P.O. box, parcel locker, freight forwarder, hotel, campus, or other destination.
Nicotine-product deliveries may require adult signature, proof of age, proof of identity, and recipient presence at delivery. The recipient must be at least 21 years old and may be required to present valid government-issued identification to the carrier or delivery provider.
Where applicable, packages may be labeled as containing tobacco or nicotine products and may be subject to carrier rules, adult-signature services, shipping records, reporting obligations, tax obligations, and delivery restrictions.
Delivery dates are estimates only. We are not responsible for delays caused by carriers, weather, customs, address errors, failed age verification, refused delivery, unavailable recipients, regulatory holds, payment review, or events outside our reasonable control. If a package is returned, refused, seized, destroyed, undeliverable, or cannot be delivered because of incorrect information, failed age verification, an unavailable adult recipient, a restricted destination, or violation of these Terms, we may deduct shipping, adult-signature, return, restocking, regulatory, and other non-refundable costs from any refund to the extent permitted by law.
11. Returns, Refunds, and Short-Dated Products
Because the products sold on the Site may be regulated, consumable, sealed, perishable, age-restricted, or subject to health and safety controls, returns are limited. We do not accept returns of opened, used, tampered, expired, damaged after delivery, or improperly stored products unless required by law or approved by us in writing.
If a product arrives with an expiration date less than 14 days from the date of delivery, you may request a refund for that product by contacting support@whitelip.com in writing within 7 business days after delivery. Include your order number, delivery date, photos of the product, and photos showing the expiration date.
If you receive the wrong product, a visibly damaged product, or a product that appears unsafe on arrival, contact us within 7 business days after delivery before using the product. We may request photos, batch information, packaging, and other information to assess the claim.
Approved refunds are generally issued to the original payment method. Shipping, adult-signature, regulatory, tax, return, and other fees may be non-refundable except where required by law or expressly approved by us. Do not return any product unless we provide written return authorization and instructions. Unauthorized returns may be refused, destroyed, or not refunded.
12. Subscriptions and Recurring Orders
If we offer subscriptions, auto-replenishment, recurring billing, memberships, or similar programs, the specific subscription terms disclosed at enrollment will apply in addition to these Terms.
By enrolling in a recurring program, you authorize us and our payment providers to charge your payment method at the disclosed frequency until you cancel, subject to age verification, product availability, shipping restrictions, and applicable law. You may cancel or manage a subscription using the method provided in your account or by contacting support@whitelip.com. Cancellation deadlines and the timing of already-processed orders will be disclosed in the applicable subscription terms.
13. Product Information, Website Accuracy, and Availability
We try to present product descriptions, images, ingredients, strengths, warnings, prices, promotions, shipping estimates, and availability accurately. However, errors, inaccuracies, omissions, and delays may occur.
Product packaging, labeling, ingredients, warnings, strengths, availability, and images may differ from what appears on the Site. You are responsible for reviewing the product label and packaging before use. We may correct errors, update information, change or discontinue products, change prices, or cancel orders affected by inaccurate information at any time, including after an order has been submitted.
14. Intellectual Property and Website License
The Site and its text, graphics, logos, product images, page designs, software, icons, videos, audio, content, trademarks, service marks, and other materials are owned by Whitelip or our licensors and are protected by intellectual-property and unfair-competition laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, lawful, non-commercial purposes. You may not copy, reproduce, modify, distribute, sell, resell, exploit, scrape, frame, reverse engineer, or create derivative works from the Site or its content without our prior written permission.
15. User Content, Reviews, and Feedback
If you submit reviews, comments, photos, testimonials, ideas, suggestions, questions, feedback, or other materials (collectively, “User Content”), you grant Whitelip a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, edit, adapt, publish, translate, distribute, display, and create derivative works from that User Content in any media, subject to our Privacy Policy and applicable law.
You represent that your User Content is truthful, lawful, your own original content or content you have permission to submit, and does not infringe any rights of others. If you received compensation, a discount, free product, or other benefit in connection with a review or endorsement, you must clearly and conspicuously disclose that relationship.
We may monitor, edit, refuse, or remove User Content at our discretion, including content that is unlawful, misleading, promotional, offensive, defamatory, obscene, infringing, medically inappropriate, directed to minors, or inconsistent with these Terms or applicable law.
16. Third-Party Services, Links, and Payment Providers
The Site may include or rely on third-party services, links, content, tools, payment methods, age-verification services, analytics, advertising technologies, shipping providers, customer-support tools, and e-commerce platform services, including WordPress, WooCommerce, Klaviyo, Google, Meta, Microsoft, Kustom, carriers, and other providers.
Third-party services are governed by the third party’s own terms and privacy notices. We are not responsible for third-party websites, tools, content, policies, actions, omissions, or availability. If we provide access to optional third-party tools, those tools are provided “as is” and “as available” without warranties from Whitelip, except to the extent expressly required by law
17. Privacy
Your submission of personal information through the Site is governed by our Privacy Policy. The Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, including information used for age verification, order processing, payment, shipping, compliance, analytics, advertising, and customer support. By using the Site, you acknowledge that we may process personal information as described in the Privacy Policy and as necessary to operate a regulated adult-only e-commerce site.
18. Prohibited Uses
You may not use the Site or products for any unlawful, fraudulent, abusive, harmful, unauthorized, or prohibited purpose. Without limitation, you may not: (a) access, order, receive, or use products if you are under 21; (b) purchase products for a person under 21; (c) provide false age, identity, billing, shipping, or account information; (d) resell, divert, export, or distribute products without written authorization and required licenses; (e) violate any federal, state, local, tribal, or territorial law; (f) interfere with Site security or operation; (g) upload malware; (h) scrape, crawl, harvest, or collect data except as allowed by law; (i) infringe intellectual-property or privacy rights; (j) harass, threaten, defame, or discriminate; (k) submit false, misleading, or medically inappropriate product claims; or (l) attempt to circumvent age verification, fraud controls, shipping restrictions, taxes, or compliance measures.
We may suspend or terminate access to the Site, cancel orders, close accounts, report suspected violations, and cooperate with law enforcement, regulators, carriers, payment providers, or other third parties if we believe these Terms or applicable law have been violated.
19. Electronic Communications and Marketing Messages
You consent to receive electronic communications from us, including order confirmations, account notices, age-verification notices, shipping updates, policy updates, and customer-service messages. Electronic communications satisfy any legal requirement that communications be in writing to the extent permitted by law. If you opt in to marketing emails, SMS messages, or similar communications, you may opt out using the unsubscribe or opt-out instructions provided in the message or by contacting us. Transactional and service-related communications may continue even if you opt out of marketing.
20. Disclaimer of Warranties
To the maximum extent permitted by law, the Site, third-party tools, and products are provided on an “as is” and “as available” basis, except for any express written warranty or mandatory statutory rights that apply. We disclaim all warranties not expressly provided, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, accuracy, and availability. Some jurisdictions do not allow certain warranty exclusions or limitations. In those jurisdictions, exclusions and limitations apply only to the maximum extent permitted by law. Nothing in these Terms is intended to disclaim, limit, or exclude rights that cannot be disclaimed, limited, or excluded under applicable law.
21. Limitation of Liability
To the maximum extent permitted by law, Whitelip and its officers, directors, employees, agents, affiliates, contractors, licensors, service providers, suppliers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages; lost profits; lost revenue; loss of data; loss of goodwill; business interruption; replacement costs; or similar damages arising out of or related to the Site, products, orders, delivery, inability to use the Site, or these Terms, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Site, products, orders, delivery, or these Terms will not exceed the greater of: (a) the amount you paid to Whitelip for the specific product or order giving rise to the claim; or (b) $100.
Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, or other liability that cannot be limited by law. State consumer-protection, warranty, product-liability, and other laws may provide rights that these Terms cannot waive.
22. Indemnification
You agree to defend, indemnify, and hold harmless Whitelip and its officers, directors, employees, agents, affiliates, contractors, licensors, service providers, suppliers, and partners from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to: (a) your breach of these Terms; (b) your violation of law; (c) your misuse of the Site or products; (d) your false or inaccurate information; (e) your User Content; (f) your purchase for, transfer to, or provision of products to a person under 21; or (g) your infringement of any rights of another person or entity.
23. Governing Law, Venue, and Dispute Terms
These Terms and any dispute arising out of or related to the Site, products, orders, delivery, or these Terms are governed by the laws of the State of Illinois and applicable federal law, without regard to conflict-of-laws principles that would require the application of another jurisdiction’s law.
Subject to any mandatory consumer-protection rights that apply in your jurisdiction, you agree that any lawsuit or court proceeding arising out of or related to these Terms, the Site, products, orders, or delivery will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction and venue in those courts. To the maximum extent permitted by law, you and Whitelip agree that claims must be brought individually and not as a plaintiff or class member in any class, consolidated, collective, representative, or private attorney general action. Nothing in this section prevents either party from seeking relief in small claims court where permitted.
24. Severability, No Waiver, Assignment, and Entire Agreement
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, sale of assets, change of control, operation of law, or transfer of business operations. These Terms, together with the Privacy Policy and any policies or additional terms referenced here or posted on the Site, constitute the entire agreement between you and Whitelip regarding the Site and supersede prior or contemporaneous understandings regarding the Site.
25. Changes to These Terms
We may update, modify, or replace these Terms at any time by posting an updated version on the Site or by providing notice as required by law. The updated Terms are effective when posted unless a later effective date is stated.
Your continued use of the Site after updated Terms become effective constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Site.
